Given the NLRB’s recent decision in Purple Communications, Inc. allowing employees use of Company e-mail for non-work purposes and the NLRB’s strong enforcement policy with regard to employers’ social media policies in light of employees Section 7 rights, employers are at an quandary of how to control use of electronic communication devices in the workplace or on the job site. How does an employer control or restrict the use of a cell phone when employees are calling and texting on the job?
